PRICING DISCLAIMER

All prices are subject to change. For all prices, products and offers, goccoPress reserves the right to make adjustments due to changing market conditions, product discontinuation, manufacturer price changes, errors in advertisements and other extenuating circumstances.

YOUR REGISTRATION OBLIGATIONS

Account registration and verification is required in order to create a goccopress account. During registration, all users are required to provide accurate, complete and current information about themselves in all required fields. Should any of your own information change after submitting it to goccoPress, you are required to update that information as soon as possible. Should goccoPress suspect that your personal information is not complete, current, or accurate, your account may be subject to suspension or termination without notice. INDEMNITY

Any contracts, verbal or written or assumed, in conjunction with your deleted account and all its parts, at goccoPress's discretion, will be terminated as well. goccoPress may also, in its sole discretion and at any time, discontinue providing the Service, or any part thereof, with or without notice. You agree that any termination of your access to the Service under any provision of this TOS may be effected without prior notice, and acknowledge and agree that goccoPress may immediately deactivate or delete your goccoPress account and all related information and files. goccoPress reserves the right to bar any further access to such files or the Service. You agree that goccoPress shall not be liable to you or any third-party for any termination of your access to the Service. Accounts that are terminated will not be refunded.

CONDUCT

You understand that all Content, including without limitation, all information, data, text, software, music, sound, photographs, graphics, video, messages, or other materials, whether publicly posted or privately transmitted, are the sole responsibility of the person from which such Content originated.goccoPress does not control Content posted via the Service and, as such, does not guarantee the validity of such Content. (b) GOCCOPRESS MAKES NO WARRANTY THAT (i) THE SERVICE WILL MEET YOUR REQUIREMENTS, (ii) THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, (iii) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICE WILL BE ACCURATE OR RELIABLE, (iv) THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU THROUGH THE SERVICE WILL MEET YOUR EXPECTATIONS, AND (V) ANY ERRORS IN THE SOFTWARE WILL BE CORRECTED.

(c) ANY MATERIAL DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE SERVICE IS DONE AT YOUR OWN DISCRETION AND RISK AND THAT YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA OR OTHER LIABILITYTHAT RESULTS FROM THE DOWNLOAD OF ANY SUCH MATERIAL.

(d) NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM GOCCOPRESS.COM OR THROUGH OR FROM THE SERVICE SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THE TOS.

LIABILITY

YOU EXPRESSLY UNDERSTAND AND AGREE THAT GOCCOPRESS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF GOCCOPRESS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM: (i) THE USE OR THE INABILITY TO USE THE SERVICE; (ii) THE COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES RESULTING FROM ANY GOODS, DATA, INFORMATION OR SERVICES PURCHASED OR OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO THROUGH OR FROM THE SERVICE; (iii) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA; (iv) STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE SERVICE; OR (v) ANY OTHER MATTER RELATING TO THE SERVICE.

RESTOCKING FEES

A 25% restocking fee will be applied to all returns for refund. Shipping charges are non-refundable. No refunds after 30 days.

ORDERS

An order is not binding upon goccoPress until it is accepted; goccoPress must receive payment before it will accept an order. Payment for product(s) ordered is due prior to shipment. Customer can make payment by credit card, or some other method prearranged with goccoPress. You agree to pay the amount(s) due as specified on the invoice, and you agree to pay interest on all past-due sums at a rate of 1.5% per month or the highest rate allowed by law, whichever is greater.

SHIPPING CHARGES

Your total cost for purchase of any product will include shipping and handling charges shown on the goccoPress invoice.

RISK OF LOSS

goccoPress will arrange for shipment of ordered product(s) to the Customer, Free On Board (F.O.B.) shipping point, meaning title to the product(s) and risk of loss passes to the Customer upon delivery to the carrier. goccoPress reserves a purchase money security interest in the product(s) until its receipt of the full amount due. Customer agrees to allow goccoPress to sign appropriate documents on Customer's behalf to permit goccoPress to protect its purchase money security interest. goccoPress will advise Customer of estimated shipping dates, but goccoPress will, under no circumstances, be responsible for delays in delivery, and associated damages, due to events beyond its reasonable control, including without limitation, acts of God or public enemy, acts of federal, state or local government, fire, floods, civil disobedience, strikes, lockouts, and freight embargoes.

GOVERNING LAW AND JURISDICTION

Any dispute arising out of or related to these Terms and Conditions or the sales transaction between goccoPress and Customer shall be governed by the laws of the State of Washington, without regard to its conflicts of law rules. Specifically, the validity, interpretation, and performance of this agreement shall not be governed by the United Nations Convention on the International Sale of Goods. goccoPress and Customer consent to the exclusive jurisdiction and the exclusive venue of the State Courts of the State of Washington, King County, to resolve any dispute between them related hereto, and the parities waive all rights to contest this exclusive jurisdiction and venue of such Courts. Finally, the Customer also agree not to bring any legal action, based upon any legal theory including contract, tort, equity or otherwise, against goccoPress that is more than 30 days after the date of the applicable invoice.

WAIVER

The failure of either party to require performance by the other party of any provision of this agreement shall not affect in any way the first party's right to require such performance at any time thereafter. Any waiver by either party of a breach of any provision in this agreement shall not be taken or held by the other party to be a continuing waiver of that provision unless such waiver is made in writing.

ENTIRE AGREEMENT

These terms and conditions, together with goccoPress's invoice regarding the products ordered by Customer, are the complete and exclusive agreement between goccoPress and Customer, and they supersede all prior or contemporaneous proposals, oral or written, understandings, representations, conditions, warranties, and all other communications between goccoPress and Customer relating to the subject products. This agreement may not be explained or supplemented by any prior course of dealings or trade by custom or usage.

DISAGREEMENT OF TERMS AND CONDITIONS OF USE

If you disagree with any of the terms and conditions of this User Agreement, please do not visit, browse, shop, access or otherwise use this site. Your use of this Web site signifies your agreement to be bound by the terms of this Agreement.
